Property ownership is one possible basis for applying for temporary residence in Montenegro. It is not automatic: the applicant must meet the general conditions for a permit, prove the relevant property right and submit the evidence required by the current law. This article summarizes the ownership route in force on 13 October 2026; it does not predict an individual decision.

The current ownership threshold

Article 56 of the consolidated Law on Foreigners permits an application based on a property right when the applicant meets the general requirements in Article 43 and submits cadastral evidence of ownership. A co-owner must hold at least one half of the property. The law identifies houses, holiday homes, villas, apartments, hospitality buildings, mixed residential-commercial buildings and business premises as qualifying property categories.

For applicants who must prove value, the law specifies a decision issued by the competent local authority for real-estate transfer tax, with a taxable base of at least €150,000. This is the municipal transfer-tax assessment base; it is not simply the seller’s asking price or a marketing valuation. The statute does not clearly resolve every practical question about how the threshold is applied where the applicant owns a share, so obtain a written answer for the exact property and ownership structure before relying on it.

The value-evidence requirement does not apply to EU nationals or their family members, or to nationals of Iceland, Liechtenstein, Norway and Switzerland. That exception concerns submitting the value evidence; it does not remove the other permit conditions. A proposal or news report mentioning a different threshold should not be treated as current law unless it appears in an adopted and effective legal text.

General permit conditions still apply

Article 43 also requires evidence of means of subsistence, accommodation, health insurance and a valid travel document or qualifying identity document, alongside the basis for the application. It includes criminal-record, entry-ban, public-order, national-security and public-health conditions. Which documents prove those points, how they must be translated or authenticated, and how long they remain valid should be checked with the Ministry of Interior before filing.

Ownership is therefore one part of the file, not a substitute for the rest. The official consolidated Law on Foreigners includes the current Articles 43 and 56. Law 3/2026 entered into force on 17 January 2026, and a later Law 33/2026 amendment was published in March; check the Official Gazette records and consolidated text for transitional provisions that may matter to an existing permit.

Check the property evidence before purchase

Ask a lawyer to confirm that the cadastral entry identifies the applicant as owner of the required share and that the legal category of the property fits Article 56. Obtain the local tax authority’s assessment decision and verify the taxable base and the name of the owner it covers. Do this before treating a property as a residence route: a listing price, private appraisal, contract price or annual property-tax notice is not the specific evidence described in Article 56.

The foreign-buyer article explains why buyer nationality and asset type need their own review. If you are considering a home in Kotor, the Kotor catalogue can help identify properties to investigate, but it cannot establish immigration eligibility or the value used by a municipality.

Apply and renew through the responsible authority

The Ministry of Interior decides residence applications. Confirm the current filing office, form, required originals, translations, fees and appointment process directly with the Ministry for the place where you will reside. Keep a copy of the submission and proof of any filing; do not rely on an agent’s estimate of processing time as a legal deadline or promise.

Before a permit expires, ask the authority which renewal evidence applies to your case and file within the current statutory window. Changes to the ownership, applicant’s share, address or other underlying facts may affect the renewal. A transition rule may treat an already-issued permit differently from a first application, so existing holders should check the current text rather than assume the new-applicant threshold applies—or does not apply—to them.

Residence is not permanent residence or citizenship

An ownership-based permit is temporary residence. It does not itself grant permanent residence, citizenship, an unrestricted right to work or a guarantee of renewal. The Government’s permanent-residence guidance states that time on temporary residence based on disposal of property is excluded from the ordinary five-year permanent-residence calculation. Anyone planning a long-term move should compare the residence basis, work rights, family circumstances and future status separately.

For a practical document sequence, see the residency guide. For the property transaction itself, see the buying-process guide and the purchase tax and cost article.

Questions people ask

What is the current property-value evidence threshold?

For applicants who must submit value evidence, Article 56 specifies a local transfer-tax decision with a taxable base of at least €150,000. Confirm the decision and its treatment for your ownership share before relying on it.

Does the €150,000 evidence rule apply to every nationality?

The law exempts EU nationals and their family members, and nationals of Iceland, Liechtenstein, Norway and Switzerland, from submitting that value evidence. The other residence conditions still apply.

Does a property-based temporary permit count toward permanent residence?

Government guidance says time on temporary residence based on property is excluded from the ordinary five-year permanent-residence calculation. Check the current law and your own history with the authority.
