Taxes and costs when buying property in Montenegro
Separate transfer tax, possible VAT and transaction expenses before you compare a resale with a new development.

The asking price is only one line in a purchase budget. The tax treatment can differ between a resale and a taxable supply by a developer, while notarial, legal, financing and registration-related charges depend on the transaction. Ask for a written estimate that names each payer and assumption before you agree a completion date.
Resale transfer tax
For transactions within the real-estate transfer-tax system, the current progressive scale is 3% on a taxable base up to €150,000; €4,500 plus 5% of the amount above €150,000 up to €500,000; and €22,000 plus 6% of the amount above €500,000. The bands apply to the taxable base, not automatically to an advertised figure. The competent local authority can determine the relevant value under the law, so do not assume the contract price will be accepted without assessment.
The rates were introduced in Official Gazette 28/2023 and remain in the current Tax Administration consolidation, published 22 June 2026. The September 2026 amendment changed household and exemption wording, not the rate scale; verify the current text and treatment of the exact transaction. The current consolidated transfer-tax law, the 2023 Official Gazette rate amendment, the 2026 amendment effective 1 April and the September 2026 amendment are the primary references.
New property and VAT
A sale by a developer may fall under VAT rather than the transfer-tax treatment used for many resales. The answer depends on the seller, the property and the taxable supply; “new build” in an advertisement is not enough to determine it. Ask the seller to identify the legal seller, whether VAT is chargeable, whether it is included in the quoted price and what invoice or contract wording will evidence the treatment.
Montenegro amended its VAT framework in 2026, including the treatment of construction land. A transaction involving land or a development can therefore require a current tax review rather than a copied calculation from an older brochure. Read the Tax Administration’s 2026 VAT amendment notice and ask a tax professional how it applies to the exact supply. Do not add VAT on top of an asking price unless the seller’s documents show that it is excluded, and do not assume a resale is VAT-free without checking the facts.
Other transaction costs
Request separate estimates for notarial services, independent legal advice, translation or interpretation, bank transfers and any agreed agency commission. A mortgage can add lender valuation, arrangement, security and registration costs. Building or title irregularities can also create professional or administrative work, but there is no single fee that applies to every file. Confirm current tariffs and who pays each item directly with the relevant provider.
The buying-process guide explains when to request these estimates. For a specific home, compare the contract, cadastral extract and payment schedule side by side. The Kotor catalogue can help you identify properties for a viewing; it does not establish tax treatment or the final amount due.
Annual tax after completion
Purchase tax is not the same as the annual immovable-property tax. The Government states that annual property tax is set within a legal range and applies to land, buildings and separate building units; local rules and the assessed property value affect the actual bill. Ask the municipality for the current calculation, due dates and owner-record requirements after the transfer. The official immovable-property tax guidance is a starting point, not an individual assessment.
If the property will be rented, ask a local tax adviser to review rental income, registration and any applicable local tourist charges separately. If residence is part of the plan, property ownership does not itself grant a permit: see the current property-residence article.
Build a transaction-specific budget
Use a worksheet with the agreed purchase price, the tax basis and method, any VAT treatment, each professional fee, financing costs and a contingency for identified document or building issues. Mark which figures are confirmed by an authority or provider and which are estimates. Ask the lawyer and notary to confirm filing responsibilities and deadlines for the actual contract; this guide does not calculate an individual liability.
Questions people ask
Is the transfer-tax calculation based automatically on the asking price?
No. The tax base is determined under the law and the competent authority may assess the value. Ask how the exact transaction will be assessed before using a price in your budget.
Is transfer tax charged on every new development purchase?
Not necessarily. The seller, supply and current VAT rules matter. Ask the developer to confirm in writing whether VAT applies and whether it is included in the stated price.
Is annual property tax the same as purchase transfer tax?
No. Transfer tax relates to an acquisition; annual immovable-property tax is a separate recurring municipal charge on property.
